About Saifullah Khan

Mr. Khan, an international trade, privacy and policy lawyer, has more than twenty years of experience in the areas of international trade policy and law advisory. He carries expertise in WTO Laws, which includes Agreement on Antidumping, Agreement on Subsidies & Countervailing Measures, Agreement on Safeguards, General Agreement on Trade in Services (GATS) etc. He also practices Anti-Trust and Competition Law, Data Protection & Cyber Security, IT & E- Commerce, Trade Agreements, issues relating to para-tariff & non-tariff barriers etc.

Mr. Khan has an extensive experience of practicing Trade Defense Laws (antidumping & others) in different jurisdictions. In particular, he has been providing antidumping legal consultancy both to domestic industry and foreign producers/exporters. He has served clients in many countries and has experience of dealing with antidumping laws of many jurisdictions including EU, Canada, Turkey, India, Pakistan etc. He also advises clients on tariff related issues including tariff setting, tariff protection and concessional tariff. Mr. Khan did an Executive Education program on “Mastering Trade Policy” from Harvard Kennedy School, Boston, USA. He had participated in an Executive Education Program on Negotiation (PON) at Harvard Law School, hosted by the Global Business School in Dubai.

He had been engaged by International Trade Centre (ITC), Geneva for developing a course for Commerce & Trade Group Officers (of the Government of Pakistan) on Trade Remedy Laws & Dispute Settlement Mechanism of the WTO. He delivered lectures to the Government Officers on Trade Remedy Laws including Antidumping, Subsidies & Countervailing Measures and Safeguards as well as on Dispute Settlement Mechanism of the WTO.

Cognizant of development and significant importance of digital economy, Mr. Khan during the past few years has given special attention to the legal framework concerning e-Commerce, data protection & privacy and cyber security. He is taking keen interest in the emerging legal frameworks on personal data protection. He is advising clients from different jurisdictions about data privacy compliance, cross-border transfer of data etc. He has carried out training sessions for the public& private sector organizations regarding compliance framework under the upcoming personal data privacy law in Pakistan. He has contributed professional articles about Personal Data Protection for Global Legal Group’s International Comparative Legal Guide to Data Protection, Lexology, Legal 500, Chambers & Directors, Mondaq and for One Trust Data Guidance. In addition to Data Protection, Mr. Khan has been writing articles on the subjects relating to International Trade laws, Competition law, Arbitration, Anti Money Laundering etc. Mr. Khan has completed a certificate course on “Data: Law, Policy and Regulation” from London School of Economics and Political Science (LSE). He is a Member of International Association of Privacy Professionals (IAPP).

In the areas of Antitrust & Competition law (merger & acquisition, cartels & restrictive agreements, monopolies and abuse of dominant positions), he has been providing advisory services to clients for compliance with the applicable legal framework and representing the clients before authorities. He has designed a training module on “Competition Compliance Program” and has imparted the training to a number of his clients.

Mr. Khan regularly participates in events organized by international organizations(like UNCITRAL, UNCTAD, FAO, WTO, UN/CEFACT etc.) as a speaker/panelist/moderator. His recent interventions within the United Arab Emirates (UAE)/NENA region includes:

  1. Mr. Khan is a member of NENA Regional Network of Experts on Agriculture Trade (RNE-AT) of the Food and Agriculture Organization (FAO) of the United Nations. As RNE-AT, Mr. Khan participated in a training course organized by the FAO. The course was held at Rabat, Morocco during May 30th to June 3rd 2022. The course was on “Facilitating Trade for Food Security” for NENA Region. In this course Mr. Khan delivered a presentation, to the course participants from fifteen countries, on “Managing Imports of Food in NENA Region, Particularly the Imports of Grains from Major Supply Sources”. He also attended a meeting of members of RNE-AT for which Mr. Khan developed an issue paper on “Ensuring Food Security Through Use of Big Data & Analytics” and delivered a presentation on the same during the meeting.
  2. Delivered a lecture to the Government Officers of the UAE at Mohamamd Bin Rashid School of Government (MBRSG) at Dubai. The lecture was on Global Governance and Antidumping being one of the emerging public policy issues (March 13, 2022).
  3. Do Agri Data needs to be regulated and if so why? Participated as one of the panelists in a session “Big Data and Analytics for AgriFood Systems”. The session was part of a two-days “Food for Future Summit & Expo” held at Exhibition Center, Expo 2020, Dubai, organized by the Ministry of Climate Change and Environment of the UAE and Food and Agricultural Organization of the United Nations. Mr. Khan expressed his thoughts on the need and challenges to regulate the Agri Data collection through Information & Communication Technology means (February 23rd, 2022).
  4. Delivered a lecture (as a guest lecturer) to the students of Bachelors in Finance of the Zayed University, Abu Dhabi on “Anti-Dumping and Derivatives”. The lecture uniquely connected derivatives with anti-dumping to show derivatives as a potentially beneficial risk management tool in relation to likelihood of imposition of anti-dumping duties (November 30, 2021).

In addition to the above, he participated as a panelist / moderator / speaker in number of international events, as follows:

  1. Mr. Khan has been awarded with the prestigious “Top 100-Lex Falcon Awards” at the Lex Talk Global Hybrid Conference on 8th April 2021, in Dubai. During the conference, Mr. Khan delivered a presentation on “Antidumping Measures: Know your legal rights and manage your risk”.
  2. Mr. Khan was a speaker in webinar jointly organized by S.U.Khan Associates Corporate & Legal Consultants - Pakistan and Legal 500 – United Kingdom entitled ” A Guide to Cyber Security, Privacy and Data Protection in Pakistan”. The webinar was held on March 04, 2021, and attended by a large number of participants from around the world. During the webinar, Mr. Khan explained salient features of the draft Personal Data Protection Bill, 2020 of Pakistan.
  3. Presented paper on “Legal Issues in e-Commerce” at e-Commerce Conference “Trade Facilitation & Electronic Business – Forum Hangzhou” organized by UN/CEFACT from 14th to 17th October 2018 in Hangzhou, China.
  4. Involved in supervision of Individual Research Paper (IRP) on the topic “A Critical Review of European Union’s Anti-Dumping Policies-A Case Study of EU-Pakistan PET Case” by the participant of 26th Mid Career Management Course at the National Institute of Management (NIM), Islamabad, Pakistan.
  5. Spoke about e-Commerce success story in Pakistan during a panel discussion at South Asian Association for Regional Cooperation (SAARC) Chamber of Commerce and Industry regional workshop on BUILDING BRIDGES DIGITALLY – E-COMMERCE AND ITS POTENTIALS IN SOUTH ASIA in Colombo Sri Lanka (Oct-2018).
  6. Participated in the ‘10th International IT Forum Attended by BRICS and SCO countries’, held at Khanty-Mansiysk, Russia from June 5th to June 6th 2018 wherein Mr. Khan shared his thoughts in a meeting of experts of the BRICS and SCO Business Council focusing on the matter of ‘Digitalization is an impulse to development of business cooperation between the BRICS and the SCO countries.’
  7. Presented paper on “International and domestic initiatives to encourage financial inclusion and the development of e-commerce” in a seminar on “Financial Inclusion and E-Commerce Issues, Information and Discussion” organized by Commercial Law Development Program (CLDP), United States Department of Commerce in association with the United States Agency for International Development (USAID) at Pakistan Telecommunication Authority, Islamabad (PTA) on May 08, 2018. The participants of the seminar included representatives from State Bank of Pakistan (SBP), PTA, Nayatel, PTCL, Karandaaz, MasterCard, Jazz and Telenor.
  8. Participated in the World Economic Forum Annual Meeting 2018 in Davos-Klosters, Switzerland 23rd – 26th January 2018.
  9. Moderated a Panel discussion “Achieving Full Potential of GSP Plus” during the event “Thank EU” organized by the EVOLVE Business Publication held at Marriot Hotel Islamabad on December 07, 2017 which was well attended by Diplomats, Government Officers and Business Executives to offer thanks to EU for awarding GSP Plus status to Pakistan.
  10. Presented paper on “E Commerce, Challenges and Opportunities for Arab Countries” in a seminar on Preparations for the 11th WTO Ministerial Conference: A Regional Perspective 30 October - 01 November 2017, Dubai, UAE. This seminar was organized jointly by the Ministry of Economy, UAE and Islamic Development Bank. Participants included senior officers of Ministry of Trade & Economy from Gulf and North African countries.
  11. Actively participated in the Public Forum organized by the WTO in Geneva from September 26 – 28, 2017. The theme of this Public Forum was “Trade Behind the Headlines”.
  12. Mr. Khan participated in the 50th session of UNCITRAL held at Vienna on July 03 – 21, 2017 as “Alternate Pakistan’s Representative” He also assists online businesses to maintain a compliant online business by offering legal services including contract drafting, reviewing and negotiating, privacy and data protection, consumer protection, intellectual property and advertising etc.
  13. Participated in the Aid for Trade Global Review 2017 under the theme “Promoting Trade, Inclusiveness and Connectivity for Sustainable Development” held at the WTO in Geneva from 11th to 13th July, 2017.
  14. Actively participated in the Public Forum organized by the WTO in Geneva from September 27 – 29, 2016. Mr. Khan was the only private sector participant from Pakistan in the said public forum and he shared very useful suggestions and made valuable recommendations in the best interest of multilateral trading system.
  15. Actively participated in the fourteenth session of the Ministerial Conference of the United Nations Conference on Trade and Development (UNCTAD 14), co-hosted by the Government of Kenya and UNCTAD, in Nairobi, Kenya (from 17 to 22 July 2016).
  16. Participated in UNCTAD experts group meeting on Trade Facilitation, Geneva, Switzerland in 2009.
  17. Participated in consultative meeting of WTO, Geneva, Switzerland on “Negotiating Group on Rules” (Sep-2009).
  18. Participated in the Amsterdam Global Conference on Sustainability and Transparency (2006 and 2008).

He is a Member of the International Chamber of Commerce (ICC) Pakistan Commission on Alternate Dispute Resolution & Mediation. Mr. Khan has been representing his clients before the Appellate forum and has also been pleading and defending his clients in before the superior courts in Pakistan. He is an Advocate enrolled with Bar at Islamabad, Pakistan and Member of the Chartered Institute of Arbitrators (CIArb) United Kingdom.

During his professional career, Mr. Khan visited Austria, Belgium, China, Czech Republic, France, Hungary, India, Indonesia, Italy, Kenya, Malaysia, Morocco, Netherlands, Qatar, Russia, South Korea, Sri Lanka, Switzerland, Thailand, Turkey, UK and USA for advisory services, for attending international events and for holding meetings with international directors with whom different cases/projects were being carried out in international trade matters.
